All Intellectual Property is owned absolutely by Millennium FX. For the purpose of this agreement “Intellectual Property” shall mean all intellectual property of whatever kind, copyright, design rights (whether registered or unregistered) trademarks (whether registered or unregistered) all related and neighbouring rights, in and to the Hire.
Millennium FX will not be liable for, nor in respect of, any claims for death or personal injury, loss or damage to property or otherwise howsoever arising out of or in connection with the hire save where this is the result of the negligence of Millennium FX or of its servants or employees and gives no warranties as to fitness for purpose. The Client is strongly recommended to take out appropriate insurance as it is the Client’s responsibility to keep the Hire in good condition and is responsible for the full cost of repair or replacement (if not capable of repair) of the Hire.
Unless agreed otherwise, the Client is responsible for all shipping and transport of items. If Millennium FX is requested to make arrangements for shipping via post, courier or shipping company on the Client’s behalf, then the liability and responsibility for the safe and timely delivery of any goods, prosthetics items, etc. lies entirely with the Client and not Millennium FX. Millennium FX will endeavour to package items suitably for shipping and make them available to a courier at the agreed time, but once collected from Millennium FX premises or agreed location all liability and responsibility for the items transfers to the Client. If schedules necessitate crew to fly out with the build, Millennium FX cannot be held responsible should the build be lost or delayed in transit.
In regard to hand built animatronics with many delicate parts, there is always a minor risk that they can falter, particularly after transit. Should this occur, Millennium FX crew will be on hand for repairs and maintenance. In the rare circumstance that some maintenance be required, Millennium FX crew will need time during the shooting day or event to conduct the repairs.
Millennium FX is to be credited for all work designed, created and applied, that is publicised on National/International TV including VOD/AdSmart, Cinema, Online/Internet/Digital/Content, Roadshows and Trade events, as well as all forms including all social media channels, YouTube, MPUs, Cinemagraph and pre-rolls etc. This also includes PR stills/films etc.
